On August 22, 2025, the Environmental Protection Agency (EPA) published interim rule titled Temporary-Use Incinerators and Air Curtain Incinerators Used in Disaster Recovery. This interim rule authorizes the deployment of air curtain burners in federally declared emergency declared areas to accelerate debris management and recovery efforts.

Under the interim rule, air curtain burners of any capacity may operate without prior approval, provided the operator:

  • Operates within the declared emergency area
  • Use the equipment according to the manufacturer’s guidelines
  • Burn only clean wood and vegetative debris
  • Maintains required visible emission (opacity) limits
  • Keep accurate operational records of throughput
